General Terms And Conditions

Introduction


Here are our terms and conditions. These are always applicable when you use or place an order through our Website and contains important information for you as a buyer. Therefore, please read the terms and conditions carefully. We recommend you to save or print these conditions, so you can read them at a later time.




Definitions


1 Tjin's Toko: established in Amsterdam and registered with the Chamber of Commerce under registration number KvK 82416133 trading as Tjin's Toko. 

2 Website: the website of Tjin's Toko, can be found on www.tjinstoko.nl and all of its subdomains.

3 customer: the natural person not acting in course of a profession or business that enters into an agreement with Tjin's Toko and/or registered on the Website. 

4 agreement: any appointment or agreement between Customer and of any agreement the Tjin's Toko general conditions integral part. 

5 General conditions: these general conditions.




Applicability General Conditions


1 The general Terms and Conditions applies on all offers, agreements and deliveries of Toko Tjin's, unless otherwise explicitly agreed upon in writing. 

2 When customer states other conditions in his order, confirmation or communication that differ from the General Terms and Conditions or are not in the General Terms and Conditions, it is only binding for Tjin's Toko, if and in so far as these have been accepted in writing by Tjin's Toko.




Prices and information


1 all prices stated on the Website of Tjin's Toko include taxes and other duties imposed by the Government. 

2 the shipping price starts at  € 6,50. These costs can also be found on the Website. In addition, these costs will be displayed during the ordering process.

3 the content of the Website is composed with the greatest care. However, Tjin's Toko cannot guarantee that all information on the website is correct and complete at all times. All prices and other information on the Website and in other materials are therefore subject to obvious programming and typing errors. 

4 Tjin's Toko cannot be held responsible for defects (color) as a result of display quality.




Establishment Agreement


1 The agreement will be concluded at the moment of acceptance by the customer on the offer of Toko Tjin's and complying with the conditions laid down by Tjin's Toko.
2 Upon digitally accepting the offer, Tjin's Toko will immediately confirm receipt of acceptance of the offer. Until receipt of this acceptance is not confirmed, the customer has the possibility to dissolve the agreement. 

3 If Tjin's Toko finds that incorrect data is submitted buy the customer. Tjin's Toko holds the right to fulfil its duties after the correct data is submitted.




Registration


1 Customer can register via the registration form/the account sign-in option on the Website to fully make use of the website's activities
2 during the registration process, Customer chooses a user name and password with which he once registered can log in to the Website. Customer is solely held responsible for choosing a sufficiently reliable password.

3 Customer's login credentials, user name and password are strictly confidential. Tjin's Toko shall not be liable for any misuse of the login credentials and should always assume that the customer who logs on to the Website, actually is the customer. Everything is done via the account of customer, is the responsibility and the risk of the customer.

4 If customer knows or suspects that have come into the hands of unauthorized log-in data, he has to change his password as soon as possible and/or to inform Tjin's Toko so that we can take appropriate measures.




Implementation Agreement


1 once the order has been received by the Tjin's Toko, Tjin's Toko will deliver the products as soon as possible, in accordance with theconditions laid down in paragraph 3 of this article.

2 Tjin's Toko is entitled to make use of third parties in carrying out the obligations arising from the agreement. 

3 the delivery period is, in principle 30. The method of delivery can take place in a number of ways and is at the discretion of Tjin's Toko.

4 if Tjin's Toko cannot deliver the products within the agreed period, it shall inform the customer. Customer can agree to a new delivery date or has the ability to end the agreement free of charge.

5 Products delivered to customer should be inspected and it is recommended that the defects are reported within a reasonable time, preferably in writing or by e-mail. See further the article on warranty and conformity.

6 once the products have been delivered at the specified delivery address, the customer is responsible.




Right Of Withdrawal


1 if customer is a natural person not acting in the exercise of his profession or business, the customer has the right within the distance contract to end the agreement within 14 working days after receiving the product, without giving any reason, free of charge.
Only the direct cost of the return shipping will be paid by customer. Customer should therefore itself carry the cost of return.
Any costs paid by customer for shipping and payment of the product to the customer of the entire order will be refunded to Customer. This is also applicable for Gift cards.

2 within the withdrawal period referred to in paragraph 1, Customer will handle the product and the packaging. Customer shall only use the product packaging open and only to the extent necessary to the operation of the nature, characteristics and products. 

3 Products can be returned conform article 1, within 7 days when customer has informed Tjin's Toko about this matter.

4 The amount of the returned products will be refunded as soon as possible or within 2-3 business days after ending the agreement.
5 Customer will be reminded of accepting the terms and conditions prior closing the agreement.

6 The right of withdrawal does not apply to:
Products that are established by the trader in accordance with the consumer's specifications;
-Products which can quickly decay or become obsolete;




Payment 


1 customer must make use of the payment options provided on the website. Tjin's Toko is free in the choice of offering payment methods and these can also change from time to time.

Warranty and compliance
1 Toko Tjin's guarantees that the products fulfill the agreement, the specifications stated in the offer, the reasonable requirements and/or usability and on the date of the conclusion of the agreement existing legal provisions and/or Government regulations. If specifically agreed, Tjin's Toko also guarantees that the product is appropriate for other than normal use.

2 A warranty by Tjin's Toko, manufacturer or importer does not alter the legal rights and claims that the customer under the agreement already has.

3 If the delivered product does not meet the agreement, Customer must notify Tjin's Toko within a reasonable time after he has discovered the defect.

4 When the complaint is validaded. The product will be replaced or refunded. The maximum fee is equal to the price paid for the product by the customer.



Shelf life
All food products have a shelf life. The shelf life per product depends on the manufacturer, importer and/or turnover rate. Tjin's Toko guarantees a minimum shelf life of 1 month after receipt of goods unless otherwise stated.

Complaints procedure

1 if customer has a complaint about a product (in accordance with Article regarding warranty and conformity) and/or on other aspects of the services provided by Tjin's Toko, he shall make an complaint through phone, email or by post. See the contact information at the bottom of the general terms and conditions. 

2 Tjin's Toko will respond to the complaint as soon as possible or within a maximum of 14 days. If it is not possible to give a definite response within above stated period, then Tjin's Toko will give an indication of the expected outcome within 14 days after the complaint has been filed. 



Personal Data


1 Tjin's Toko processes the customers personal data conform the privacy statement.




Final Provisions


1 On the agreement Dutch law is applicable.

2 as far as not otherwise required by rules of imperative law, all disputes which may arise from the agreement be submitted to the Dutch court in the district where Tjin's Toko is established.

3 if any provision of these terms and conditions is found to be void, this does not affect the validity of the entire terms and conditions. Parties will in that case need to replace (a) new provision (s) to determine that extent possible to the intent of the original provision is shaped
.
4 under "writing" in these general conditions also communication by e-mail and fax means, provided that the identity of the sender and the integrity of the email enough it is established.
